QPARTZ Ltd. – Parts Warranty Policy (B2C)

1. Scope & Definitions
1.1. “Consumer” means a natural person acting for purposes outside his trade, business, craft or profession.
1.2. “Trader” / “Seller” means QPARTZ Ltd., registered in Malta, supplying mechanical parts (new, used, aftermarket) to consumers.
1.3. “Goods” means any mechanical part (new, used, aftermarket) supplied by the Seller, together with any accompanying installation instructions or documentation.
1.4. “Legal Guarantee” (also “Guarantee of Conformity”) means the statutory rights of the consumer under the Consumer Affairs Act Cap. 378 (Malta) which apply automatically to consumer purchases.
1.5. “Commercial Warranty” means the additional warranty offered voluntarily by the Seller, on the terms set out below, in addition to the Legal Guarantee.
2. Legal Guarantee of Conformity (Statutory Rights)
2.1. Under Maltese law, when a consumer purchases Goods from a trader, the Goods must conform with the contract of sale: they must be of satisfactory quality, fit for the purposes for which goods of the same type are normally used, match any description given, and be free from hidden defects.
2.2. The consumer is entitled to remedies (repair, replacement, reduction of price or contract termination) if the Goods are faulty or non-conforming.
2.3. The period for claiming these remedies is two (2) years from the date of delivery of the Goods to the consumer.
2.4. The consumer must inform the Seller in writing (email or registered letter) of the lack of conformity within two (2) months of discovering the defect. Failure to do so may prejudice the consumer’s rights.
2.5. The Legal Guarantee does not cover faults or failures caused by:
(a) normal wear and tear or ageing of the Goods, or expected lifespan of the part;
(b) misuse, abuse, over-stress, incorrect installation (unless the installation was part of the contract with the Seller), modifications, or failure to follow installation or usage instructions.
2.6. When the defect becomes apparent within twelve (12) months of delivery, it is presumed to have existed at delivery (unless the Seller proves otherwise). After that period, the consumer may have to prove the defect existed at delivery.
2.7. These statutory rights cannot be waived or reduced by contract or term (for consumer purchases) — any commercial warranty offered is additional and cannot replace them.
3. Commercial Warranty – Terms & Conditions
In addition to the Legal Guarantee, QPARTZ Ltd. offers the following Commercial Warranty, provided the consumer meets all conditions listed below:
3.1. Duration: This Commercial Warranty covers the Goods for the following periods from the date of purchase (invoice date):
(a) New and Aftermarket Parts: One (1) year.
(b) Used / Second-Hand Parts: Three (3) months.
3.2. Conditions for validity: To make a valid claim under this Commercial Warranty the consumer must:
(a) Present the original purchase invoice issued by QPARTZ Ltd.
(b) Notify QPARTZ Ltd. in writing (email or registered letter) of the defect within 2 months from the date the defect was discovered. Failure to notify in writing within 2 months may result in refusal of the claim under this Commercial Warranty.
(c) Provide proof that the Goods were installed by a licensed/registered garage or mechanic entity (legal entity with valid licence) within 30 days after purchase — provide professional installation invoice or receipt. If no such proof is submitted, the Commercial Warranty is void.
(d) Use the Goods in a manner consistent with the manufacturer’s instructions, installation instructions and accepted usage for that part (normal usage, no abuse, no modifications outside specification).
(e) The consumer must make the Goods available to QPARTZ Ltd. for inspection. Failure to provide reasonable access to the Goods for inspection may result in a delay or refusal of the claim under this Commercial Warranty.
3.3. Coverage: If a valid claim is made under this Commercial Warranty and the defect is covered under these terms, QPARTZ Ltd. will, at its option, repair or replace the defective Goods. This warranty covers the cost of the replacement part and the associated installation labour, provided that all warranty-related labour is performed at QPARTZ Ltd.’s premises. QPARTZ Ltd. is not responsible for any labour costs incurred at any other garage.
3.4. Exclusions: The Commercial Warranty does not cover:
(a) Normal wear and tear, ageing of the part, decreased performance due to expected lifespan of a used or aftermarket part.
(b) Damage or failure resulting from abnormal use, misuse, over-stress, abuse, modification, neglect, overheating, failure to follow installation or usage instructions.
(c) Incorrect installation of the Goods when installation was carried out by a non-licensed/unregistered mechanic entity or when installation was not part of the contract of sale and no proof of professional installation is provided.
(d) Any claim under the Commercial Warranty for which the consumer failed to meet the notification requirement under 3.2(b), or failed to provide required documentation under 3.2(c).
3.5. Effect on Legal Guarantee: The Commercial Warranty is in addition to the Legal Guarantee. It does not replace, reduce or limit the consumer’s statutory rights under the Legal Guarantee of Conformity. The consumer remains free to rely on those rights at any time within the two-year period if the goods are non-conforming.
3.6. Replacement does not restart warranty: If the Goods are replaced under this Commercial Warranty, the original purchase date remains the basis for both the Legal Guarantee and the term of the Commercial Warranty (the warranty period does not reset).
3.7. Inspection: QPARTZ Ltd. reserves the right to inspect the Goods (or have them inspected by a third-party professional) before accepting a claim under the Commercial Warranty.
4. Applicability to All Goods (New, Aftermarket, Second-Hand)
4.1. This policy applies to all mechanical parts supplied by QPARTZ Ltd., whether new, aftermarket or second-hand/used.
4.2. For second-hand or used parts: The Legal Guarantee still applies (2 years), but the condition of the part (used, remaining lifespan, prior wear) will be relevant when assessing conformity. The expected lifespan and usage may differ from a new part.
4.3. The consumer acknowledges that used/aftermarket parts may have reduced remaining life, may carry prior wear, and that such pre-existing wear may not amount to a “lack of conformity” if the part performed as reasonably expected given its condition.
4.4. The Commercial Warranty terms (Sections 3.2-3.4) apply equally to new, aftermarket or used parts, subject to installation, documentation and usage conditions.
5. General Terms
5.1. This policy applies only to Goods supplied to consumers (not to businesses/traders) by QPARTZ Ltd. for private, non-commercial use.
5.2. This policy is governed by the laws of Malta and any consumer dispute may be submitted to the competent Maltese courts or the Malta Competition and Consumer Affairs Authority (MCCAA).
5.3. Any term in this policy which attempts to limit or exclude the Legal Guarantee of Conformity shall be void and unenforceable. The consumer’s statutory rights remain unaffected.
5.4. If any provision of this policy is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
5.5. The consumer is advised to keep the original purchase invoice, proof of installation, any professional mechanic invoices, and any correspondence relating to faults or defects.
5.6. Where a claim is made under the Legal Guarantee, QPARTZ Ltd. will comply by repairing or replacing the Goods free of charge, or by providing another statutory remedy (reduction or contract termination) as mandated by law.
5.7. Where the consumer purchases an extended or additional warranty beyond this Commercial Warranty, the terms of that extended warranty shall be provided in writing, and clearly state the existence of the Legal Guarantee and how the extended warranty operates in addition to it.
QPARTZ Ltd. – Labour Warranty Policy (B2C)

1. Scope & Definitions
1.1. “Consumer” means a natural person acting for purposes outside his trade, business, craft or profession.
1.2. “Service Provider” means QPARTZ Ltd., registered in Malta, which carries out mechanical installation, fitment, replacement, commissioning and testing labour services on motor vehicles for consumers.
1.3. “Labour Services” means the mechanical work performed by the Service Provider in connection with removal, installation or fitment of vehicle parts, and associated commissioning/testing.
1.4. “Labour Warranty” means the voluntary warranty provided by the Service Provider covering the Labour Services, over and above any parts warranty or statutory rights of the Consumer, on the terms set out below.
2. Labour Warranty – Terms & Conditions
2.1. Duration: The Labour Warranty covers the Labour Services for a period of one (1) week (7 calendar days) from the date the vehicle is collected by the Consumer from the Service Provider’s premises.
2.2. Conditions for validity: To make a valid claim under this Labour Warranty the Consumer must:
(a) Present the vehicle collection receipt issued by QPARTZ Ltd.
(b) Notify QPARTZ Ltd. in writing (email or registered letter) of any fault in the Labour Services (installation, fitment, mechanical connection) within the one-week period from collection.
(c) Ensure the vehicle has not been subject during the one-week period to modification, abuse, incorrect use, overloading, or maintenance outside the manufacturer’s or Service Provider’s recommendations.
(d) Provide the vehicle for examination upon request by QPARTZ Ltd. at its premises.
2.3. Coverage: If a valid claim is made under this Labour Warranty and it is determined that the fault arises solely from the Labour Services provided by QPARTZ Ltd. (and not from the part supplied, the underlying vehicle condition, misuse, or external causes), QPARTZ Ltd. will re-perform the Labour Services free of charge (replacement labour) at its option. No refund of the original labour charge will be made.
2.4. Exclusions: The Labour Warranty does not cover:
(a) Faults or failures caused by parts which were not supplied or ordered from QPARTZ Ltd. In instances where the part was supplied by the Consumer, the parts warranty of QPARTZ Ltd. does not apply; only the labour portion may be considered under this Labour Warranty.
(b) Normal wear and tear, expected deterioration of the installation, or external damage or misuse of the vehicle after the service;
(c) Any work, modification or part replacement performed by any third-party after the vehicle’s collection without prior written consent from QPARTZ Ltd.;
(d) Faults resulting from vehicle system faults, subsequent incorrect installation, or causes outside the scope of the original Labour Services;
(e) Any claim not notified within the one-week period or in which the Consumer has refused reasonable inspection/verification by the Service Provider.
2.5. Relation to Parts Warranty / Statutory Rights: The Labour Warranty is in addition to any parts warranty offered by QPARTZ Ltd. and any statutory rights the Consumer has under law in respect of the parts or goods supplied. It does not replace or limit those parts warranties or statutory rights.
2.6. No extension of period upon performance: If QPARTZ Ltd. re-performs the Labour Services under this warrantied claim, the original one-week period remains the benchmark: the Labour Warranty does not restart or extend beyond that initial period.
2.7. Inspection: QPARTZ Ltd. reserves the right to inspect the vehicle, the installation, or parts fitted, and to request access to relevant records, before accepting a claim under this Labour Warranty.
3. Applicability
3.1. This Labour Warranty applies only to Labour Services carried out by QPARTZ Ltd. for Consumers (private persons) and not to Labour Services carried out for businesses/traders.
3.2. This policy applies where QPARTZ Ltd. has performed the Labour Services, whether installing parts supplied by QPARTZ Ltd. or, in exceptional cases, installing parts supplied by the Consumer (subject to condition 2.4(a)).
3.3. Labour Warranty claims must be made within the one-week period; after that time, QPARTZ Ltd. will consider only the applicable parts warranty (or statutory rights) for the parts involved.
4. General Terms
4.1. This policy is governed by Maltese law and any dispute may be submitted to the competent Maltese courts or the Malta Competition and Consumer Affairs Authority (MCCAA).
4.2. Any term in this policy that attempts to exclude or limit the Consumer’s statutory rights under applicable consumer law shall be void to the extent of that inconsistency.
4.3. If any provision is found invalid or unenforceable, the remainder of the policy remains in full force and effect.
4.4. The Consumer is advised to keep the service receipt, any documentation of parts installed, usage/maintenance records, and any communication relating to faults or claims.
