Terms and Conditions for QPARTZ Ltd.

1. Introduction & Acceptance of Terms

 

Welcome to QPARTZ Ltd. ("we", "us", "our"). These Terms and Conditions ("Terms") govern your use of our website, www.qpartz.mt (the "Website"), and the services and products we provide, including vehicle repairs, diagnostics, and the sale of parts (collectively, the "Services").

By accessing or using our Website, creating an account, booking a service, or purchasing products, you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use our Website or Services.

4. User Conduct & Account Registration

 

4.1. Account Registration: You may be required to create an account to access certain features. If you create an account, you agree to:

  • (a) Provide accurate, current, and complete information.

  • (b) Maintain the security and confidentiality of your password and account credentials.

  • (c) Accept full responsibility for all activities that occur under your account.

4.2. Acceptable Use: You agree not to use the Website for any purpose that is unlawful or prohibited by these Terms. You must not:

  • (a) Use the site for any fraudulent or illegal purpose.

  • (b) Attempt to hack, "scrape," disrupt, or gain unauthorised access to the Website or its servers.

6. Description of Services & Products

 

QPARTZ Ltd. is a specialist garage providing services including, but not limited to, vehicle diagnostics, scheduled maintenance, engine and body repairs, and classic restorations. We supply new OEM, aftermarket, and certified used parts for BMW and Porsche vehicles. All services and products are provided subject to the terms herein.

 

7. Booking, Deposits & Cancellations

 

7.1. Booking: Appointments for services can be made via our Website, by message, or by phone. Booking via the Website is the preferred method.

7.2. Deposit: A €10 deposit is required to secure your service appointment. This deposit will be deducted from your final bill.

7.3. Cancellation Policy:

  • (a) 24+ Hours Notice: If you cancel or reschedule with at least 24 hours' notice, your €10 deposit will be credited toward your next scheduled appointment. Deposits are not refunded.

  • (b) Less than 24 Hours Notice: If you cancel or reschedule with less than 24 hours' notice, your €10 deposit is forfeited.

  • (c) No-Show: If you fail to attend your appointment without prior notice, your €10 deposit is forfeited.

 

8. Estimates, Quotations & Additional Work

 

8.1. Service Estimates: We provide free, non-binding estimates for repair services. An estimate is a good-faith approximation of costs and is subject to change if unforeseen issues are discovered once work begins.

8.2. Authorisation for Additional Work:

  • (a) If additional necessary work is identified and the cost is €150 or less, you authorise QPARTZ Ltd. to proceed with the work without seeking prior approval.

  • (b) If the cost of additional work exceeds €150, we will contact you for approval before proceeding.

    8.3. Parts Quotations:

  • (a) Validity: Price quotations for parts are valid for a specific period: 30 days for new original or new aftermarket parts, and 1-2 days for second-hand parts.

  • (b) Availability: Availability is also time-sensitive: 14 days for new original or new aftermarket parts, and 1-2 daysfor second-hand parts.

  • (c) Final Price: All prices are subject to change based on supplier costs, shipping fees, and import taxes. The final price will be confirmed with you before your deposit is taken.

 

9. Payment Terms

 

9.1. Payment Due:

  • (a) Routine Jobs: Payment in full is due upon completion of the service and before the vehicle can be collected.

  • (b) Special Projects (e.g., Restorations): QPARTZ Ltd. reserves the right to define staged payment schedules as the work progresses and will invoice the customer accordingly.

    9.2. Accepted Methods: We accept payment by Cash, Debit Card, and Bank Transfer.

    9.3. Non-Payment: Failure to pay for services or parts will result in the actions detailed in Section 14 (Mechanic's Lien) and Section 12 (Storage Fees).

 

10. Parts Ordering & Delivery

 

10.1. Deposit: A 70% non-refundable deposit is required for all parts orders with a value over €50.

10.2. Special Orders: All special-order parts are strictly non-returnable and non-refundable.

10.3. Delivery Times: All delivery timeframes provided are estimates. QPARTZ Ltd. is not liable for any delays caused by circumstances beyond our reasonable control, including but not limited to supplier backorders, shipping delays, or customs processing.

10.4. Returns Policy: We do not accept returns or provide refunds for parts that are unwanted or ordered by mistake by the customer. Your rights for faulty or non-conforming goods are covered by our Parts Warranty Policy.

 

11. Collection & Storage

 

11.1. Uncollected Parts: If parts ordered by a customer are not collected, or if an appointment for their installation is not booked, within three (3) months of the customer being notified of their arrival, the parts and the 70% deposit will be forfeited.

11.2. Uncollected Vehicles: A grace period of one (1) day will be given after the customer is notified of service completion. After this period, any vehicle not collected will be subject to a daily storage fee of €5.00, which will be added to the final bill.

 

12. Warranties

 

12.1. Legal Guarantee: As a consumer, you are entitled to a 2-year legal guarantee for lack of conformity on all goods sold, in accordance with the Malta Consumer Affairs Act. This legal right is not affected by any commercial warranty we offer.

12.2. Parts Warranty: In addition to your legal rights, we offer a voluntary Commercial Warranty on parts. The full terms, conditions, exclusions, and claim procedures for this warranty are detailed in our "Parts Warranty Policy." This policy is incorporated herein by reference.

13. Customer Responsibilities & Garage Liability

 

13.1. Personal Belongings: The customer is solely responsible for removing all personal belongings and valuables from their vehicle before service. QPARTZ Ltd. is not responsible for any loss or damage to personal items left in the vehicle.

13.2. Limitation of Liability: While we exercise all reasonable care, QPARTZ Ltd. shall not be liable for:

  • (a) Any pre-existing damage, faults, or wear and tear on the vehicle.

  • (b) Loss or damage to the vehicle resulting from events beyond our reasonable control, including fire, theft, vandalism, or natural disasters.

  • (c) Damage that occurs during repair as a direct result of the vehicle's age or pre-existing poor condition (e.g., seized bolts shearing, brittle plastic components breaking).

 

14. Mechanic's Lien

 

In accordance with the law, QPARTZ Ltd. reserves the right to exercise a legal lien (right to retain possession) over any customer vehicle in our possession until the total outstanding bill for services, parts, and any accrued storage fees has been paid in full.

 

15. General Limitation of Liability

 

To the fullest extent permitted by law, QPARTZ Ltd. shall not be liable for any indirect, incidental, or consequential damages. This includes, but is not limited to, loss of income, loss of use of the vehicle, car rental costs, or accommodation bills arising from repair delays, parts delays, or service complications.

 

16. Dispute Resolution & Defamation

 

16.1. Informal Resolution: In the event of a complaint or dispute, you agree to first contact QPARTZ Ltd. directly at info@qpartz.eu to seek an informal resolution. We are committed to resolving issues amicably and ask that you provide us a reasonable opportunity to address your concerns before taking public or formal action.

16.2. Defamation: QPARTZ Ltd. takes its reputation seriously. We reserve all legal rights to pursue damages and other remedies against any party that makes false, malicious, or defamatory statements about our business, services, or staff in a public forum.

16.3. Formal Resolution: This does not prevent you from exercising your rights as a consumer. You may file a complaint with the Malta Competition and Consumer Affairs Authority (MCCAA).

16.4. Governing Law & Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Republic of Malta. Any legal action or proceeding shall be subject to the exclusive jurisdiction of the courts of Malta.

 

17. Modification of Terms

 

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page, and the "Last Updated" date will be revised. Your continued use of the Website or our Services after such changes are posted constitutes your acceptance of the new Terms.

 

18. Severability

 

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from the Terms, and the remainder of the Terms shall continue in full force and effect.
